1. Introduction and Acceptance

Welcome to Ads2Publish.com. These Terms & Conditions ("Terms") govern your access to and use of the website www.ads2publish.com and the advertisement booking services offered through it (together, the "Platform").

By accessing the Platform, creating an account or booking an advertisement, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it. They do not require a physical or digital signature.

2. About Us

The Platform is owned and operated by Ads2Publish ("Ads2Publish", "we", "us" or "our").

Ads2Publish is an official ad booking partner of more than 200 newspapers, which have authorised us to accept advertisement bookings online on their behalf.

3. Definitions

Advertiser, you or your means any person or entity that accesses the Platform or books an advertisement through it.
Advertisement or Ad means any text, image, design or other material you submit for publication.
Publication means a newspaper or other print publication in which an Ad is booked through the Platform.
Booking means a request placed through the Platform to publish an Ad in a Publication.

4. Eligibility

You may use the Platform only if you are at least 18 years old and competent to contract under the Indian Contract Act, 1872.

If you book on behalf of a company, firm or another person, you confirm that you are authorised to bind them to these Terms.

5. Your Account

You must provide accurate, current and complete information when you register or book, and keep it updated.
You are responsible for keeping your login credentials confidential and for all activity under your account.
Tell us promptly at customercare@ads2publish.com if you suspect unauthorised use of your account.
We may ask for identity or address proof to verify an account or a Booking.

6. Our Services and How Booking Works

Ads2Publish is an online platform for booking newspaper advertisements. We are an authorised ad booking partner of the Publications listed on the Platform and accept Bookings on their behalf. We do not own or control any Publication, and each Publication makes the final decision on publishing an Ad.

A Booking is a request. It is confirmed only when payment is received in full and the Publication accepts the Ad.
Every Booking is subject to the Publication's own rate card, deadlines, space availability, advertising policy and editorial discretion.
The Publication may reject, reschedule or reposition an Ad. We do not guarantee a specific page, position or publication date unless we confirm it in writing.
We make every effort to have your Ad published on the requested date. If for any reason it is not published on that date, it will be moved to the next available date and we will inform you.
Bookings received after the Publication's cut-off time may be published in the next available edition.
No compensation is payable for any reason if an Ad is not published on the selected date. If you do not want the Ad published on the next available date, our only obligation is to refund the amount actually paid for that Ad, as set out in Section 12.
You are responsible for selecting the correct category and for checking the Ad text, design, dates and edition before you confirm a Booking.
If an Ad is booked under the wrong category, we will ask you to move it to the correct category and pay any difference in price. If you do not agree, the Booking will be cancelled and a 15% cancellation charge will apply.

7. Advertiser Responsibilities

By using the Platform, you agree to:

Provide accurate, truthful and lawful Advertisement content.
Ensure your Ad complies with all applicable Indian laws, including the Consumer Protection Act, 2019, the guidelines on misleading advertisements issued under it, and the Code of the Advertising Standards Council of India (ASCI).
Hold all licences, registrations, permissions and consents needed for the Ad and for the goods or services it promotes.
Take sole responsibility for the content of your Ad and for any claims or responses arising from it.

8. Advertisement Content Guidelines

We accept Ads in good faith but reserve the right to reject or remove any Ad that violates these Terms, the law or the Publication's policy.

We may make minor edits for formatting, length or the Publication's requirements. We will seek your approval before making any change that alters the meaning of your Ad.

Prohibited content includes:

False, misleading or unsubstantiated claims.
Fraudulent financial schemes, unregistered investment or deposit schemes, and get-rich-quick offers.
Hate speech, obscene content, defamation, or content that promotes enmity between groups.
Political or election advertising that does not meet the Publication's policy or applicable election rules.
Illegal goods or services, counterfeit products, and material that infringes another person's intellectual property.
Advertising that is banned or restricted by law, such as tobacco and alcohol products, lotteries and gambling, prenatal sex determination, and "magic remedy" cures for diseases.
Real estate, financial, medical, educational or recruitment Ads that lack the registrations or disclosures required by law.

9. Documents and Verification

Some Ad categories require supporting documents before publication. These include name change, lost document, public notice, legal notice, matrimonial, obituary, recruitment and property Ads.

We or the Publication may ask for identity proof, an affidavit, a police complaint or FIR copy, a registration certificate or other documents.
An Ad will not be processed until the required documents are received. Delay in providing them may change the publication date.
You confirm that every document you submit is genuine. We may keep copies as required by law or by the Publication.

10. Pricing, Taxes and Payment

All Ads must be paid for in full and in advance. Prices vary by Publication, edition, location, Ad type, size and date.
Prices shown on the Platform are in Indian Rupees. Goods and Services Tax (GST) and any other applicable taxes are charged in addition, unless stated otherwise.
Rates displayed may change without notice. The price that applies is the one shown when you confirm the Booking.
If a price was displayed incorrectly due to an error, we will contact you before processing. You may then pay the correct price or cancel for a full refund.
Payments are processed by third-party payment gateways. We do not store your card or banking credentials.
If a payment fails or is debited twice, the excess amount will be reversed according to the payment gateway's and your bank's timelines.
A tax invoice will be issued for each confirmed Booking. Please provide your GSTIN at the time of Booking if you need it on the invoice.

11. Cancellation and Changes

You may cancel or modify a Booking only if it has not yet been sent to or processed by the Publication.
A cancellation charge of 15% of the Booking amount applies to cancellations made at your request.
To cancel or modify, email customercare@ads2publish.com with your Booking reference as early as possible.
Once a Booking has been processed by the Publication, it cannot be cancelled or changed.
Changes that affect the size, edition or date of an Ad may change the price.

12. Refund Policy

You are eligible for a full refund if:

Ads2Publish or the Publication rejects your Ad before publication for a reason that is not attributable to you.
The Ad is not published due to a fault of the Publication or of Ads2Publish, and you do not want it published on the next available date.

You are eligible for a refund after a 15% cancellation charge if:

You cancel before the Booking is processed by the Publication.
The Ad was booked under the wrong category and you do not agree to move it to the correct category and pay any difference in price.
The Ad is rejected because its content is inappropriate or does not meet our content guidelines or the Publication's policy.
The Ad cannot be processed because you did not submit the required documents.

You are not eligible for a refund if:

You provided incorrect details, text or dates and the Ad was published as submitted.
You submitted forged documents.
You cancel after the Booking has been processed by the Publication.
The Ad was published as approved by you.

How refunds work

A refund is limited to the amount actually paid for the Ad. No compensation, damages or interest is payable in addition, for any reason.
Approved refunds are credited to the original payment method within 7 to 10 working days. Your bank may take additional time to show the credit.
Payment gateway charges that are not returned to us may be deducted where the cancellation is at your request.

13. Proof of Publication and Errors

After publication, we will share a copy or e-paper clipping of the Ad on request in PDF or image format, where the Publication makes one available.
You must report any error in a published Ad within 3 days of the publication date by emailing customercare@ads2publish.com with your Booking reference and a copy of the Ad.
If a material error was caused by Ads2Publish or the Publication, we will arrange a corrected re-publication at no extra cost or refund the amount paid for that Ad, at our option.
Minor variations in font, spacing, colour or placement that do not change the meaning of the Ad are not treated as errors.
We are not responsible for errors in content that you submitted or approved.

14. Intellectual Property

All content on the Platform, including text, graphics, software and the Ads2Publish name and logo, belongs to Ads2Publish or its licensors and is protected by intellectual property laws.
The names, logos and mastheads of Publications displayed on the Platform are owned by the respective Publications. We display them with their authorisation as their ad booking partner.
You may not copy, reproduce, modify or distribute Platform content, including Publication logos, without prior written permission from us or the relevant owner.
You must not submit copyrighted or trademarked material in an Ad unless you own it or have permission to use it.
We may remove content that appears to infringe another person's rights, without notice.

15. Licence to Publish and Display Your Ad

You keep ownership of the content you submit. You grant Ads2Publish and the relevant Publication a non-exclusive, royalty-free licence to reproduce, format, adapt and publish your Ad in the print and digital editions for which it is booked.

Booked Ads are also displayed on the Platform, where they can be seen by the public. By placing a Booking, you consent to this display and agree not to object to it.

If you want your Ad removed from the Platform, email customercare@ads2publish.com with your Booking reference. We will remove it within 7 days of receiving your request. Removal from the Platform does not affect the Ad as printed or shown in the Publication's own editions.

16. Acceptable Use of the Platform

You agree not to:

Use the Platform for any unlawful or fraudulent purpose.
Attempt to gain unauthorised access to the Platform, its servers or other users' accounts.
Introduce viruses or malicious code, or interfere with the Platform's operation.
Scrape, crawl or harvest data from the Platform by automated means without our written consent.
Impersonate another person or misrepresent your connection with any person or entity.

17. Third-Party Services and Links

The Platform relies on third parties such as payment gateways and Publications, and may link to third-party websites. We do not control these third parties and are not responsible for their content, services or policies. Your use of them is subject to their own terms.

18. Data Privacy and Security

We collect and process personal data in line with our Privacy Policy and applicable law, including the Digital Personal Data Protection Act, 2023.

We use your data to process Bookings, verify documents, issue invoices, provide support and meet legal obligations.
We share the data needed to publish your Ad with the relevant Publication, and payment data with our payment gateway partners.
We do not sell your personal data to third parties.
We use analytics and personalisation only as described in the Privacy Policy and, where required, with your consent.
We use secure payment processing and reasonable security practices to protect your data.
You may request access to, correction of or deletion of your personal data, or withdraw consent, by contacting us at the details in Section 29.

Booked Ads are displayed on the Platform to give your Ad more visibility. You can ask us to remove your Ad from the Platform as described in Section 15.

Please remember that anything you include in an Ad, such as names, phone numbers or addresses, becomes public once it is published in the Publication and displayed on the Platform.

19. Communications

By creating an account or placing a Booking, you agree to receive transactional messages about your Booking by email, SMS, phone call or WhatsApp. We will send promotional messages only with your consent, and you can opt out at any time.

20. Disclaimer

The Platform and our services are provided on an "as is" and "as available" basis. We do not promise that the Platform will be uninterrupted, error-free or free of harmful components.
We try to keep rates, deadlines and other information accurate, but this information comes from Publications and may change or contain errors.
We do not verify the truth of claims made in Ads and are not liable for errors, omissions or misleading information in Ads submitted by Advertisers.
We do not guarantee any response, enquiry, sale or other result from a published Ad.

21. Limitation of Liability

To the fullest extent permitted by law:

No compensation is payable if an Ad is not published on the selected date, or is not published at all, for any reason. Your only remedy is publication on the next available date or a refund of the amount actually paid for that Ad.
Ads2Publish is not responsible for delays, omissions, rescheduling, repositioning or printing errors caused by a Publication, beyond the remedies set out in Sections 12 and 13.
Ads2Publish is not liable for any indirect, incidental, special or consequential loss, including loss of profit, business, opportunity or goodwill.
Our total liability for any claim relating to a Booking is limited to the amount you paid to us for that Booking.

Nothing in these Terms excludes liability that cannot be excluded under Indian law, or takes away your rights as a consumer under the Consumer Protection Act, 2019.

22. Indemnity

You agree to indemnify and hold harmless Ads2Publish, its owners, employees and partners, and the relevant Publications, against any claim, loss, penalty, damages or expense (including reasonable legal fees) arising from:

The content of your Ad, including any claim that it is false, misleading, defamatory, unlawful or infringes another person's rights.
Any document or information you provided that is incorrect or not genuine.
Your breach of these Terms or of any applicable law.

23. Force Majeure

We are not liable for any failure or delay caused by events beyond our reasonable control. These include natural disasters, epidemics, strikes, government orders, non-publication or suspension of a newspaper edition, power or internet failures, and payment gateway outages.

If such an event prevents publication, we will offer publication on the next available date or a refund of the amount paid.

24. Suspension and Termination

We may suspend or close your account, or refuse or cancel a Booking, if you breach these Terms, submit unlawful content or forged documents, or misuse the Platform.
You may stop using the Platform at any time and may ask us to close your account by emailing customercare@ads2publish.com.
Sections that by their nature should continue after termination will continue to apply. These include payment obligations, indemnity, limitation of liability and dispute resolution.

We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receiving it.

26. Governing Law and Dispute Resolution

These Terms are governed by the laws of India.
We encourage you to first raise any dispute with our Grievance Officer so that we can try to resolve it amicably within 30 days.
Any dispute that is not resolved amicably will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Hyderabad, Telangana, and the proceedings will be in English.
Subject to the above, the courts at Hyderabad, Telangana have exclusive jurisdiction.
Nothing in this Section prevents a consumer from approaching a consumer commission or other authority as permitted by law.

27. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date, and we will notify registered users of material changes by email or a notice on the Platform.

The Terms in force when you confirm a Booking apply to that Booking. Continued use of the Platform after an update means you accept the updated Terms.

28. General Provisions

Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and Ads2Publish regarding the Platform.
Severability: If any part of these Terms is found to be invalid or unenforceable, the remaining parts continue to apply.
No waiver: A delay or failure by us to enforce any right does not waive that right.
Assignment: You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours as part of a merger, acquisition or business reorganisation.
Relationship: Nothing in these Terms creates a partnership, agency or employment relationship between you and Ads2Publish.
